Hi,
The Final Resolution (maybe):
In the previous three posts I outlined the history behind the erosion in my back yard and the steps I had taken to try to solve that problem. No matter what I did, my back fence kept falling in the ditch behind my house, but by the last post I had taken some extra steps (replacing the wooden fence posts with extra-long metal poles, deeply embedded in concrete) to make sure the fence wouldn’t fall no matter how much ground eroded away.
The fence is now secure. Barring a hurricane or a tornado, it’s unlikely that it will fall into the ditch again, but the erosion is still happening. What is the HOA going to do about that? At this point, I have been working on a solution with them for a few years now. A little over a year ago, I was told that negotiations with a contractor had almost been finalized when an inspector found some issues with property rights and with that vendor’s proposed solution. Late last year, the HOA had their attorney do some more investigating to find out who was responsible for building and maintaining the ditch itself, and said then that they hoped to get the work done soon. The “work” hasn’t happened yet, but I’ve been dealing with it for almost ten years, and I’m tired of waiting. I had hoped (when I started this series of posts back in May) that the situation would be resolved by now, but it’s clearly not.
I attended an HOA board meeting a week ago, and raised the issue again. They assured me that fixing the erosion is a “top priority,” and they intend to have it entirely fixed before the year is over. They said their attorney has finished everything they needed him to do and they have asked for contract bids. After they’ve gathered quotes, the board will vote and choose a vendor. Then they will hold a town hall to let us know when and how the work (a sort of concrete barrier to support the soil) will be done. At least it does appear that they are moving forward. Maybe. I’ll keep my fingers crossed (except when I’m typing 😊).
The next post will be about a milestone birthday.
See you then,
Michael
